General terms and conditions of sale

Services:

Premier Cercle organises premium conferences in different formats that may take place over two hours or half a day (“Executive Briefings”), one day (“Conference”), or two days (“Summit” or “Seminar” by industry sector), hereinafter referred to as “Events”.

Online Payment Ingenico / Ogone :

Once the credit card payment has been initiated by the Customer, the transaction is immediately debited after verifying the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By giving his bank details at the time of the sale, the Customer authorizes the Seller to debit his card with the amount relating to the price indicated. The Customer confirms that he is the legal owner of the card to be debited and that he is legally entitled to use it. In case of error, or impossibility to debit the card, the Sale is immediately resolved by right and the order will be canceled.

Order and billing:

The purchase is made online on the Premier Cercle website and implies the full and complete adhesion to these terms and conditions available on the Premier Cercle website www.premiercercle.com. These conditions prevail over any condition of purchase, except formal and express waiver of Premier Cercle. Premier Cercle may need to modify these terms from time to time without previous notice. After any such changes, customers agree to comply with it and to be subject to these conditions as mentioned on the website.

When a company orders several tickets for its collaborators, a deadline to complete the name and contact details of each participant will be indicated when the client places the order. After this date, tickets to the Event will no longer be editable and access to the Event will be refused. The tickets will not be refunded.

Prices:

All prices are expressed in euros excluding VAT and shall therefore be increased by the VAT rate applicable on the date of purchase. Two VAT rates are applicable: one for the conference itself and beverages, another for catering. Catering and beverages being only accessory of the principal, i.e. the provision of intangible service (the conference itself).

Customers may benefit from discounts that are linked, in particular, to the date of registration and the number of attendees. An “early bird” price (discounted rate) is proposed at the opening of registrations, the price then increases each month.

Services are charged at a fixed rate and include the following depending on the chosen service:

- A digital service only.

*Due to Covid throughout the precautionary period which seems to extend until 2021 inclusive, the prices of the services do not include catering, coffee breaks or social aspects. The booklets will be accessible in electronic version in place of the printed booklets. The price stipulated online includes this new data and even if the place of reception requires for health reasons or other precautionary and security measures to transform the conference into a fully digital version.

Cancellation:

“Early bird” rates cannot be canceled or refunded. For full price tickets, cancellation is possible up to 20 working days before the event. A refund of 50% of the ticket price (excl. taxes) will be granted to those who benefit from a full price. After this date, no cancellation or refund will be granted. Cancellation and refund request are made by registered letter with 
acknowledgement of receipt, as attested to by postmark.

Replacement:

A person who cannot attend the Event can be replaced by someone from his/her organisation. Modification of name and contact details can be done directly through the user account. The replacements are strictly limited to members of the same organization and can be done until the date mentioned on the user account. After the mentioned date no modifications are allowed and there will be no refund as mentioned in “Order and billing”.

Payment and late payment penalties:

Payment is made online at registration, upfront, cash, without discount, by credit card (Visa, Mastercard or American Express) or, by exception, by bank transfer. In the exceptional case where the payment is made by bank transfer, if it has not been done before the date mentioned on the invoice handling fees will be applied: 150 euros for recovery services and 300 euros for litigation services.

Liability:

Any participant who is a private individual, or his/her employer, undertakes to hold Premier Cercle harmless from any physical damage direct or indirect, that may be caused. The employer or the participant undertakes to take out the relevant insurance policies for the duration of the conference, comprising waiver clauses over the right to appeal, with the result that Premier Cercle may not be held liable.

Confidentiality and intellectual property rights:

The customer commits not to reproduce, directly or indirectly, in part or in full, adapt, modify, translate, represent, commercialise or disseminate to third parties any conference material without the prior express consent of Premier Cercle, which holds the right to the trademark, logos, designs, copyright (website content) and all material used to research its events.

Impediment:

Should the number of conference participants be deemed insufficient with respect to quality, Premier Cercle reserves the right to cancel the event no later than 7 working days before it is due to take place. All registration fees paid prior to cancellation shall be fully refunded on written request by the customer. Failing this, a credit note shall be issued allowing the customer to attend the next edition of the cancelled event or a future Premier Cercle event.

Force Majeure (Impracticability):

In the event of force majeure, in particular industrial action by hauliers, transport infrastructure staff (e.g. air carrier, STIB, RATP, SNCB, SNCF, Thalys, etc.) hotel staff or staff at venues hosting the event, a last-minute withdrawal of a contributor or keynote speaker, a terrorist attack, natural disaster or for any other reason beyond the control of Premier Cercle, depending on the circumstances, Premier Cercle reserves the right to suspend or postpone the conference, change its venue or the content of its programme or replace a speaker without compensation being owed to the customer.

Data protection Act, protection of privacy and GDPR:

In accordance with the applicable laws regarding private information, data protection and protection of privacy, all information that customers are requested to provide is necessary to process their registration in full. The customer may access and modify himself his/her data through his/her personal account on the Premier Cercle website www.premiercercle.com. The client can also request the right to be forgotten (right to erasure) i.e. the client have the right to obtain the erasure of his/her personal data without undue delay.

Disputes:

All orders placed on this website are subject to Belgian law. In the event of a dispute over the interpretation, execution and performance of a service ordered online, the dispute shall, in the absence of an amicable settlement and if the customer has the status of trader, fall under the sole jurisdiction of the Commercial Court of Brussels.
